DMCA Copyright Infringement Notification Policy

A. Procedure for Reporting Copyright Infringement:
Cuptify and Cuptify.com respects the intellectual property rights of others and is committed to helping third parties protect their rights. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Cuptify.com website, please notify our copyright agent as described below. Notices should comply with the Digital Millennium Copyright Act and include the following information:

B. Once Proper Bona Fide Infringement Notification is Received by the Designated Agent:
It is the policy of Cuptify.com to remove or disable access to the allegedly infringing material, notify the content provider, member, or user that it has removed or disabled access to the material, and that repeat offenders will have the infringing material removed from the system and that Cuptify.com will terminate such content provider's, member's, or user's access to the service.

C. Procedure to Supply a Counter-Notice to the Designated Agent:
If the content provider, member, or user believes that the material that was removed or to which access was disabled is not infringing, or the content provider, member, or user believes that they have the right to post and use such material from the copyright owner, the copyright owner's agent, or pursuant to the law, they must send a counter-notice containing the following information to the Designated Agent listed above:

1. Identification of the Material: A description of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
2. Good Faith Belief Statement: A statement that you have a good faith belief that the material was removed or disabled as a result of mistake or a misidentification of the material.

4. Consent to Jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which Cuptify.com may be found, and that you will accept service of process from the person who provided notification of the alleged infringement.

If a counter-notice is received by the Designated Agent, Cuptify.com may send a copy of the counter-notice to the original complaining party informing that person that Cuptify.com may replace the removed content or cease disabling it in 10 business days.Please note that under Section 512(f) of the DMCA, any person who knowingly misrepresents that Content or activity is infringing may be subject to liability for damages, including attorney's fees.
